Notice of Appeal by Lewis Tremaine: Fairfax School Street Plaza Proposal
As noted on the Town of Fairfax website "The property located at 95 Broadway, also known as “School Street,” is
being proposed for redevelopment as a mixed-use project. This property
was identified as a potential site for new affordable housing in the
Town of Fairfax’s Housing Element, which was adopted earlier this year.
"The project applicant is proposing:
- Residential Space: 257,039 square feet comprising 202 market-rate units and 41 affordable units (25% low-income affordable).
- Commercial Space: 5,750 square feet on the ground floor.
- Parking: Two levels of parking.
- Building Height: Four stories of residential."
Former Fairfax Mayor, Lewis Tremaine, has filed a Notice (copy attached) appealing the decision of:
"Action of the Planning and Building Director, or designee, deeming the School Street Project application (a) “complete” within the meaning of SB 330 and the Housing Accountability Act, (b) eligible for streamlined ministerial approval under Town Code Chapter 17.026, (c) meeting the density requirements of the Chapter 17.126 and/or (d) not a“project” or otherwise exempt from CEQA."
Among other things, he argues that the proposed project application does not qualify for "streamlining" and ministerial review, does not qualify for benefits under Senate Bill 35, fails to provide "necessary unit density calculations," and that the applicant must be notified that the application is "incomplete."
