Town Hall Series: What Matters? The California Constitution!

As election 2024 winds down, Catalysts Institute for Local Control would like to remind readers that the fight for local control is not over. We want to thank you for your tireless advocacy. We invite you to hear two legal heroes who are fighting to keep the California Constitution relevant to constituents’ needs.

Pam Lee argued the winning SB9 court case in Los Angeles County Superior Court where on April 22, 2024, Judge Curtis Kin ruled that Senate Bill 9, the Accessory Dwelling Unit (ADU) law, does not apply to charter cities. Sonny Soltani is an expert in how to form a charter city.

1. What happens next? Five charter cities filed the lawsuit: Redondo Beach, Carson, Torrance, Whittier and Del Mar, alleging that SB9 took away their local control without providing the promised affordable housing. They won! In late October, Los Angeles judge Kin ordered CA Attorney General Rob Bonta to pay $271,243 in attorney’s fees. Bonta has filed an appeal, which will go to a panel of three judges in the Second District Court of Appeals. The hearing hasn’t been scheduled.

2. What is the relevance of this case to how the Constitution legally protects jurisdictions? How can citizens collaborate to challenge laws, city attorneys, and housing department staff who intimidate elected city councils and boards of supervisors? How can we align against state threats and use legal means to sustain the rights, safety, and well-being of constituents?
